DGW Kramer LLP Wins Dismissal of ADA Lawsuit Against New York Business

NEW YORK, September 24, 2026 — DGW Kramer LLP secured dismissal of an Americans with Disabilities Act lawsuit against The Soiree Tea Co LLC, a Manhattan business, and its landlord. On September 22, Judge Mary Kay Vyskocil of the Southern District of New York dismissed the plaintiff’s second amended complaint and closed the case.

The court held that, despite two amendments, the plaintiff had not plausibly alleged a concrete plan to return to The Soiree and therefore lacked standing to seek an injunction. The ruling did not reach the merits of the alleged accessibility violations.

Business owners face a growing burden from repetitive ADA lawsuits. DGW Kramer represents businesses facing these suits and challenges claims that cannot satisfy the requirements for proceeding in federal court.

The case is Adams v. 796-798 Ninth Successor LLC, No. 25-cv-00912 (S.D.N.Y.).
