DGW Kramer Obtained a $28 Million Freezing Order in Asset Recovery Litigation

DGW Kramer LLP represents two judgment creditors in their international efforts to satisfy monetary judgments valued over USD $50 million.  After extensive investigation and asset research, litigators at DGW Kramer LLP successfully located the judgment debtor, who fled China upon being declared insolvent, and traced his substantial asset holdings in New Zealand.  As a consequence of the combined efforts of DGW Kramer LLP, and local New Zealand counsel, the judgment creditors have secured an interim freezing order totaling NZ$40 million (approximately USD $28 million) in addition to a charging order in the amount of over NZ$5.4 million (approximately USD $3.8 million) against the judgment debtor and his assets in New Zealand.  To secure and enhance the prospect of recoveries, a team of experienced U.S. and NZ counsel, led by Mr. Rongping Wu (Larry), Managing Partner at DGW Kramer LLP, sought the injunctive relief on an emergency basis.  The New Zealand court ultimately agreed with the sound reasoning and arguments of counsel and issued the interim freezing order on the grounds that there was a clear and present risk of dissipation of New Zealand assets by the judgment debtor.  This case presents an excellent example of sophisticated legal strategies in recovering assets globally against judgment debtors who abscond from their home jurisdictions.

The issuance of the two orders by the New Zealand court also serves as an affirmative acknowledgment of international comity and reciprocity.
