On October 18, 2021, DGW Kramer LLP litigation partner Katie Burghardt Kramer gave a guest presentation to students at the University of Pennsylvania Law School, regarding Section 1782 discovery and cross-border judgment enforcement. 

Ms. Kramer was invited by Assistant Professor Yanbai Andrea Wang to present as part of a course entitled “Litigating Across Borders.”  The seminar participants, both J.D. students and L.L.M. students, were highly engaged.  Ms. Kramer spoke in particular about her amicus brief to the U.S. Supreme Court in the matter of Servotronics v. Rolls-Royce PLC, et al., on behalf of a group of Chinese arbitrators, regarding the application of Section 1782 discovery to private international arbitration. 

Ms. Kramer also spoke about New York’s foreign judgment enforcement laws, and addressed the pending appeal of Shanghai Yongrun Investment Management Co., Ltd., v. Kashi Galaxy Venture Capital Co., Ltd., et al., in which the New York trial court refused enforcement of a Chinese civil judgment on the basis of a finding of a systemic lack of due process.  Ms. Kramer addressed both the nuts-and-bolts practicality of cross-border litigation along with the big picture questions of why these laws are valuable and how they may be improved.
